Terms of Service

1. Agreement
By booking a session with Eclectic Soul Photography, you agree to the following terms and conditions. This agreement constitutes a binding contract between you (the client) and Eclectic Soul Photography.

2. Booking and Payment
A non-refundable deposit is required to secure your session date and time.
Full payment must be made before the session date.
Payment can be made via Square, Cashapp, Venmo, Zelle, & Cash.


3. Rescheduling and Cancellations
Clients may reschedule their session at least 48 hours in advance without penalty.
Sessions canceled within 48 hours of the scheduled time will result in forfeiture of the deposit.


4. Image Delivery
Eclectic Soul Photography will provide a minimum of 5 edited images from the session.
Images will be delivered within 2 weeks after the session.
The images will be provided in high-resolution digital format.


5. Creative Control
Eclectic Soul Photography retains full creative control over the editing and selection of images.
Clients may provide preferences and input, but the final decision on edits and selection rests with Eclectic Soul Photography.


6. Use of Images
Clients grant Eclectic Soul Photography the right to use images from their session for marketing, portfolio, and social media purposes.
Clients may use the images for personal use and non-commercial purposes only.


7. Liability
Eclectic Soul Photography is not liable for any injuries or damages that occur during the photo session.
In the unlikely event that technical problems or unforeseen circumstances prevent the fulfillment of the contract, liability is limited to the refund of all payments received.


8. Privacy
Eclectic Soul Photography respects your privacy and will not share your personal information with third parties without your consent, except as necessary to provide services or as required by law.


9. Amendments
These terms may be amended from time to time. Clients will be notified of any changes before their session.


10. Governing Law
This agreement is governed by the laws of the state of Kentucky as well as the state of Tennessee.
